Section 106 PA Projects in Washington

On December 4, 2018, the Federal Highway Administration - Western Federal Lands Highway Division (WFLHD) executed a Programmatic Agreement (PA) with the Federal Highway Administration - Washington Division (FHWA), Advisory Council on Historic Preservation, Federal Transit Administration (FTA), Washington Department of Transportation (WSDOT), and Washington State Historic Preservation Officer (SHPO). The objective of this PA is to make more efficient the methods by which FHWA, WFLHD, FTA, and WSDOT review individual undertakings processed under Section 106 that may affect historic properties and to establish the process by which FHWA, WFLHD, FTA, and WSDOT (as delegated) carry out their Section 106 responsibilities. Under this agreement, the signatories agree that certain undertakings will not require further Section 106 review with SHPO, FHWA, or FTA once the undertaking has been reviewed by a WSDOT or WFLHD Cultural Resources Specialist to ensure that the location or nature of the activity is such that it is unlikely to affect an historic property. WFLHD is making a list of their undertakings that will not require further Section 106 review available monthly on this page.
