Agency Responsibilities
The Federal Acquisition Regulation (FAR) 48 CFR 39.2 states when acquiring ICT, agencies must ensure:
- Federal employees with disabilities have access to and use of information and data that is comparable to the access and use by Federal employees who are not individuals with disabilities; and
- Members of the public with disabilities seeking information or services from an agency have access to and use of information and data that is comparable to the access to and use of information and data by members of the public who are not individuals with disabilities.

Standard contract clause. The contracting officer is responsible for ensuring this language is included in all contracts.
- Federal Highway Administration Form 4260: Section 508 Information and Communication Technology (ICT) Conformance Criteria is required.
- NOTE: Form FHWA Form 4260 is new and replaces Form DOT 4260.1, Section 508 Determination and Certification of EIT Purchase Requests.
