  1. What is the purpose of this Notice? This Notice is to advise of the redistribution of FY 2008 obligation authority to the States pursuant to Section 1102(d) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law (Pub. L. No.) 109-59, and Division K, Title I, Section 120(c) of the Consolidated Appropriations Act, 2008, Pub. L. No. 110-161.

  2. How much obligation authority is available for redistribution? A total of $1,160,367,604 of obligation authority is available for redistribution for FY 2008.

  3. How much obligation authority was requested? The States requested a total of $8 billion in additional obligation authority for FY 2008.

  4. How is the returned obligation authority redistributed? The amounts are to be redistributed in accordance with the requirements of Section 1102(d) of the SAFETEA-LU and Division K, Title I, Section 120(c) of the Consolidated Appropriations Act, 2008, so that priority will be given to those States having large unobligated balances of funds apportioned under Sections 104 and 144 of Title 23, United States Code.  The attached table shows the redistribution of unused obligation authority to the States.

  5. Does this Notice include any other adjustments? Yes, this Notice also includes the distribution of additional formula obligation limitation as a result of rescissions to allocated programs required by Section 186 of the Consolidated Appropriations Act, 2008, Pub. L. No. 110-161. A total of $6,886,795 of additional formula limitation is being distributed to the States. Each State is being distributed a proportional amount of the additional formula obligation limitation based on the ratio that State's total apportionments for FY 2008 subject to the limitation on obligations bears to the total of such apportionments for all States. The attached table shows the distribution of the additional formula obligation limitation to the States.

  6. What action is required? Division Administrators should ensure that that this additional obligation authority is obligated no later than September 26, 2008.
