- PURPOSE. To transmit the certificate of apportionment of Appalachian Development Highway Program funds authorized for FY 1999 pursuant to the Transportation Equity Act for the 21st Century (TEA-21). The apportionment is effective immediately.
- AVAILABILITY
- The Appalachian Development Highway Program funds resulting from this apportionment are available for obligation until expended.
- The funds resulting from this apportionment are subject to obligation controls in force at the time of obligation. Special obligation limitation is provided with these funds.
- The participating rate for these funds is 80 percent with sliding scale rates not to exceed 95 percent.
- The appropriation code is Q98, and the project number prefix is ADP.
- The Appalachian Development Highway Program funds resulting from this apportionment are available for obligation until expended.
- ACTION. Division Administrators should ensure that copies of this Notice are furnished to State Transportation Agencies.

FOR THE APPALACHIAN DEVELOPMENT HIGHWAY PROGRAM
AUTHORIZED TO BE APPROPRIATED
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1999

The Secretary of the Treasury of the United States and the State Transportation Agencies:
Pursuant to section 9503 of the Internal Revenue Code of 1986, the Transportation Equity Act for the 21st Century, title 23, United States Code, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administrator in section 1.48, title 49, Code of Federal Regulations, I certify--
First, that the Secretary of the Treasury has made the estimate required by section 9503(d) of the Internal Revenue Code of 1986 and based on that estimate, I have determined that the amount which can be apportioned for the Appalachian Development Highway Program for the fiscal year ending September 30, 1999, is $450,000,000 which is 100 percent of the amount authorized to be appropriated for that fiscal year pursuant to section 1117 of the Transportation Equity Act for the 21st Century.
Second, that in compliance with section 104(a) of title 23, United States Code, I have determined that it is appropriate to deduct 1.50 percent from the amount authorized to be appropriated for the fiscal year ending September 30, 1999, for the administrative activities associated with the Appalachian Development Highway Program and I have deducted said 1.50 percent from the sum of $450,000,000 authorized to be appropriated for the fiscal year ending September 30, 1999, by section 1117 of the Transportation Equity Act for the 21st Century.
Third, that after making the deduction, I have computed the apportionment among the several States of the amount authorized to be appropriated for the Appalachian Development Highway Program in the manner provided by law in accordance with the formula set forth in section 1117 of the Transportation Equity Act for the 21st Century.
Fourth, the sums which are hereby apportioned to each State effective immediately are respectively as follows:
