- PURPOSE
- To transmit the certificate of reapportionment of the FY 1992 Interstate Transfer funds withdrawn under the provisions of 23 U.S.C. 103(e)(4). The reapportioned amounts are provided in Attachment 1.
- To allocate FY 1994 obligation authority related to the reapportioned funds.
- To transmit the certificate of reapportionment of the FY 1992 Interstate Transfer funds withdrawn under the provisions of 23 U.S.C. 103(e)(4). The reapportioned amounts are provided in Attachment 1.
- BACKGROUND
- Section 103(e)(4) of Title 23 U.S.C. provides that any sums which are apportioned to a State for a fiscal year and are unobligated (other than an amount which by itself, is insufficient to pay the Federal share of the cost of a substitute project which has been submitted by the State to the Secretary for approval) at the end of the succeeding fiscal year shall be reapportioned among the remaining States.
- Appropriation code 177 is to be used for all projects financed with the reapportioned Interstate Transfer funds.
3. AVAILABILITY
- The reapportioned funds are available effective immediately and may be obligated in accordance with obligation control procedures in force at the time of obligation.
- The reapportioned funds which are not obligated by September 30, 1994, will be withdrawn andreapportioned.
- Section 103(e)(4) of Title 23 U.S.C. provides that any sums which are apportioned to a State for a fiscal year and are unobligated (other than an amount which by itself, is insufficient to pay the Federal share of the cost of a substitute project which has been submitted by the State to the Secretary for approval) at the end of the succeeding fiscal year shall be reapportioned among the remaining States.
- OBLIGATION LIMITATION. The 91.1 percent of FY 1994 obligation authority distributed to support obligation of these funds is shown on the attachment.
- ACTION. Division Administrators should assure that copies of this Notice are furnished to State highway agencies.

The Secretary of the Treasury of the United States and the State Highway Department:
Pursuant to section 9503 of the Internal Revenue Code of 1986, title 23, United States Code, entitled "Highways", the Intermodal Surface Transportation Efficiency Act of 1991, and the delegation of authority from the Secretary of Transportation to the Federal Highway Administration, 49 CFR 1. 48, I hereby certify--
First, that pursuant to the above statutes, the delegation of authority and 23 U.S.C. 103 (e)(4), I did on October 1, 1993, apportion among the eligible States the amount made available for apportionment for highway substitute projects for the fiscal year ending September 30, 1994, in the manner provided by law.
Second, that $18,990,175.70 of sums apportioned for highwaysubstitute projects for the fiscal year ending September 30, 1993, were unobligated sums at the end of fiscal year 1993, and that I have withdrawn such unobligated sums and computed their reapportionment in the manner provided by law among the eligible States pursuant to 23 U.S.C. 103 (e)(4).
Third, that the sums which are apportioned and made available to the eligible States, effective immediately, are as follows:
